1. Services

Cosmic Digital Studios provides digital marketing services, including but not limited to:

  • Website and funnel creation
  • Funnel optimization and A/B testing
  • Advertising campaign setup and management
  • Email marketing and automation
  • Ongoing support and consulting

All services are provided on a best-effort basis and may evolve over time.

2. No Guarantee of Results

While we aim to improve performance metrics such as conversions, leads, and revenue, we do not guarantee specific results.

Client outcomes depend on multiple factors outside our control, including but not limited to:

  • Market conditions
  • Offer quality
  • Traffic sources
  • Client responsiveness and implementation

3. Payments & Billing

  • Services may be offered as one-time or subscription-based (monthly) plans
  • Payment is due upfront unless otherwise agreed in writing
  • Subscription services automatically renew unless canceled prior to the next billing cycle
  • All fees are non-refundable unless otherwise stated in writing

4. Cancellations

  • Clients may cancel monthly services at any time
  • Cancellation will take effect at the end of the current billing period
  • No prorated refunds will be issued for partial months

5. Client Responsibilities

To ensure successful delivery, clients agree to:

  • Provide necessary access (e.g., website, ad accounts, email platforms)
  • Respond in a timely manner to requests for information or approvals
  • Ensure they have rights to all materials provided (logos, content, media, etc.)

Delays caused by lack of client response may impact timelines and results.

6. Intellectual Property

  • Upon full payment, clients retain ownership of final deliverables created specifically for them
  • Cosmic Digital Studios retains the right to reuse general frameworks, systems, and methodologies
  • We may showcase completed work in our portfolio unless otherwise agreed in writing

7. Third-Party Tools

We may use or recommend third-party platforms (e.g., advertising networks, email software, funnel builders).

We are not responsible for:

  • Platform outages or changes
  • Third-party fees
  • Policy violations or account suspensions caused by platform rules

8. Limitation of Liability

To the fullest extent permitted by law, Cosmic Digital Studios shall not be liable for:

  • Lost profits or revenue
  • Indirect, incidental, or consequential damages
  • Performance issues resulting from third-party platforms or client decisions

Our total liability shall not exceed the amount paid for services in the preceding 30 days.

9. Termination

We reserve the right to terminate services at any time if:

  • Terms are violated
  • Communication breaks down
  • Abuse, harassment, or unethical behavior occurs

Any work completed up to termination will be delivered where applicable.

10. Chargebacks & Disputes

By purchasing our services, you agree to contact us first to resolve any issues before initiating a chargeback.

Unjustified chargebacks may result in:

  • Immediate termination of services
  • Collection efforts for unpaid balances

11. Governing Law

These Terms shall be governed by the laws of the State of Washington, without regard to conflict of law principles.

12. Changes to Terms

We reserve the right to update these Terms at any time. Continued use of our services constitutes acceptance of the updated Terms.
